1. Acceptance of terms

Please read these Terms of Use ("Agreement", "Terms") carefully before using https://eber.co (the "Site") operated by EBER (Pte. Ltd.) ("us", "we", "our"). By accessing or using the Site in any manner — including visiting, browsing, or contributing content — you agree to be bound by this Agreement.

These Terms should be read alongside our Privacy Policy, which governs how we collect, use and protect your personal information, including under the Singapore PDPA 2012 and Malaysia PDPA 2010.

2. Eligibility & account registration

You must be at least 18 years old to register for and use the Service. If you sign up for the Service, you will create a personalised account with a unique username and password. You agree to notify us immediately of any unauthorised use of your account. The Company is not responsible for any liabilities, losses, or damages arising from unauthorised use of your account, username or password.

3. Use restrictions

Your permission to use the Site is conditioned on the following. You agree that you will not, under any circumstances:

  • Post information that is abusive, threatening, obscene, defamatory, or otherwise objectionable

  • Use the Service for any unlawful purpose or to promote illegal activities

  • Harass, abuse or harm another person or group

  • Use another user's account without permission, or provide false information when registering

  • Interfere or attempt to interfere with the proper functioning of the Service

  • Make automated use of the system or impose an unreasonable load on our servers or network infrastructure

  • Bypass robot exclusion headers, or use any software or device to scrape, spider, or crawl the Service or harvest data

  • Publish or link to malicious content intended to damage or disrupt another user's browser or device

  • Reproduce, duplicate, copy or sell any part of the Site without our express written consent

4. User content & posting

If your account allows you to provide User Content, you are solely responsible for content you post, upload, link to, or otherwise make available. We act only as a passive conduit for distribution of your User Content, but reserve the right to remove any User Content at our discretion.

By submitting User Content, you agree that: you are responsible for all activity under your account; you will not post malicious, false or inaccurate information; you will not submit content subject to third-party proprietary rights without permission; and we may determine whether submissions comply with these Terms, remove them, and terminate your account with or without notice. We do not pre-screen or monitor all User Content, though we may monitor or record interactions at our discretion.

5. Online content disclaimer

Opinions, advice or information made available through the Service but not directly by the Company are those of their respective authors and should not necessarily be relied upon. We do not guarantee the accuracy, completeness or usefulness of such content, and we take no responsibility for any User Content posted by users or third parties. We reserve the right, but have no obligation, to monitor materials posted in public areas of the Service or to limit access where a user violates these Terms.

6. Intellectual property & limited licence

The Site and its original content, features and functionality are owned by EBER (Pte. Ltd.) and protected by international copyright, trademark, patent, trade secret and other intellectual property laws. You may view and print pages from the Site for personal, non-commercial use only.

We grant you a non-exclusive, non-transferable, limited licence to use the Site in accordance with this Agreement. No other use is permitted without our prior written consent.

7. Copyright complaints (DMCA)

Termination of repeat infringers

We respect the intellectual property rights of others and have adopted a policy providing for termination, in appropriate circumstances, of users who are repeat infringers.

Take-down notices

If you believe, in good faith, that materials on the Service infringe your copyright, send the following to our copyright agent (see Contact Us):

  1. The date of your notification

  2. A physical or electronic signature of the person authorised to act on behalf of the rights owner

  3. A description of the copyrighted work claimed to be infringed

  4. A description of the infringing material and information sufficient to locate it

  5. Your contact information (address, phone, email)

  6. A statement of good-faith belief that the use is unauthorised

  7. A statement, under penalty of perjury, that the notification is accurate and that you are authorised to act

Counter-notices

If you believe your removed content is not infringing, you may send a counter-notice with: your signature; a description of the removed content and its prior location; a good-faith statement that removal was a mistake or misidentification; and your contact details plus consent to jurisdiction of the Singapore courts. Upon receipt, we may reinstate the content in 10–14 business days unless the original complainant files for a court order.

8. Electronic communications

Communications made through email or messaging do not constitute legal notice to the Company where notice is required by contract, law, or regulation. For contractual purposes, you consent to receive communications from us electronically, and agree that electronic Terms, notices and disclosures satisfy any legal requirement for written communication. This does not affect your non-waivable rights.

We may also use your email to send other messages, including company updates and special offers. You may opt out at any time by changing your account settings; doing so may prevent you from receiving such messages.

9. Third party links

The Site may provide links to third-party websites and content ("Third Party Sites") as a courtesy. We have no control over, and assume no responsibility for, the content, accuracy, privacy practices or policies of Third Party Sites. If you access a Third Party Site, you do so at your own risk, and our Terms no longer govern. Review the applicable terms and privacy policy of any site you navigate to from the Site.

10. Warranty disclaimer

Your use of the Site is at your sole risk. The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that: (a) the Site will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Site is free of viruses or other harmful components; or (d) the results of using the Site will meet your requirements.

11. Limitation of liability & indemnification

In no event shall EBER (Pte. Ltd.), nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for direct or consequential damages resulting from your use of the Site. You agree to defend, indemnify and hold us harmless from any claims, losses, liabilities, costs and expenses (including attorney's fees) arising from your violation of these Terms or any third party's rights.

12. Security

EBER Pte Ltd is ISO 27001 certified. We maintain technical and organisational measures aligned with our Information Security Management System (ISMS) to protect information transmitted through or stored on the Site. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

13. Termination

We may terminate your access to the Site, without cause or notice, which may result in forfeiture and destruction of information associated with you. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing law

This Agreement shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.

15. Changes to these terms

We reserve the right, at our sole discretion, to modify or replace these Terms by posting updated terms on the Site. Your continued use of the Site after such changes constitutes acceptance of the new Terms. Please review this Agreement periodically; if you do not agree to any changes, discontinue use of the Site immediately.
